We suggest our Clients and Visitors read the below terms and conditions for using the Enfermera Clinical Ltd services, website or any platform to which our website is connected to, if any.

This agreement specifies our terms and conditions which apply to all Clients whether past or present and Visitors of our website.

Parties:

"You" and "your": Means the “Client” and/or the “Visitor”

 "Us", “our” or “we”: Means Enfermera Clinical Ltd (“Enfermera Clinical” hereinafter)

Entering into a contract with us

A contract between you and Enfermera Clinical will only exist for booking a service with us once you book your request, pay for the deposit, if applicable and we confirm the date for your booked training or event. We confirm all bookings by email or text. 

Acceptance of the booking will be deemed both complete and to have been effectively communicated to you when Enfermera Clinical sends the booking confirmation email to you (whether or not you receive that email/text). The training provided will either be an ad hoc session and/or for a fixed number of sessions to be agreed with the Client.

Our fees

All payments must be made by the date on the issued invoice unless agreed otherwise with us.    

Bookings

The booking of an event or training session with us, constitutes an offer by us and acceptance by the Client to purchase the service, in accordance with these terms and conditions.

The Client must ensure that they have carefully read and understood these terms and conditions and that any specifications in the booking are complete and accurate to the best of their knowledge. In the event there is any ambiguity with these terms and conditions, the Client should contact us as soon as possible to clarify. Otherwise, it is implied that the Client understands the said terms.

Additionally, these conditions apply to the contract with the strict exclusion of any other terms that the Client seeks to impose or incorporate into the contract, including those implied by trade, custom, practice or course of dealing.

The contract shall come into effect upon Enfermera Clinical confirming a booking request with the Client and/or on the first date on which Enfermera Clinical provides its services to the Client.   

Service

Enfermera Clinical shall use all reasonable endeavours to supply its service on the agreed date within the booking. 

The service is provided by one of our Nurse Educators or a fully trained Moving & Handling Trainer. Our services include clinical training, care planning, competency assessing, provision of Medication Administration Records. This list is not exhaustive.

Enfermera Clinical reserves the right to make changes to its services in the event that it is necessary to comply with applicable UK laws and/or health and safety regulations. We will notify the Client of any proposed or actual changes to the service by telephone and/or in writing by email, as soon as is reasonably practicable.

Cancellation

By Enfermera Clinical: 

Enfermera Clinical reserves the right to cancel the service (or any aspect of the service) where:

the Client breaches any of its duties or obligations under the contract;
Enfermera Clinical is of the view or understanding that the Client has requested a significant change to the contract or service;
We are of the reasonable belief that the Client or its employees, agents and/or guests are under the influence of any substances or is intoxicated and that might affect understanding and participation;

  • We are of the reasonable belief that the event might prejudice the reputation of Enfermera Clinical; or
  • We are legally required to do so or if ordered by any government or public authority.

 

By the Client:

The booking will be deemed cancelled when a Client provides written notification to us of the same, cancels or postpones the entire booking. In the event of termination of the contract for any reason, whatsoever, Enfermera Clinical shall have the right to impose a cancellation fee, which shall be calculated as detailed below:

 

  • If cancelled within 48hrs of the booked session, the cancellation charge shall be 50% of the fee;
  • If cancelled on the day of the booked session, 100% cancellation charge applies.

Deposit

Deposit payments will be agreed on an individual booking basis at the discretion of Enfermera Clinical.

Payment methods

Enfermera Clinical accepts payment of fees by way of BACS and bank transfers. We will provide details of our bank account to you to make payment/s on our invoices.

Using our website and security

By accessing and using our website at www.enfermeraclinical.com you are agreeing to be bound by the current terms and conditions of use including any relevant local laws. You are entirely responsible for any activity that occurs by you on our website. You agree that you will notify us immediately of any unauthorised use and/or any other breach of security during the use of our website.

You agree to abide by all applicable local, state, national and international laws and regulations and are solely responsible for all acts or omissions that occur under your usage, including the content of your transmissions through our website. All information, designs, artwork, videos, music and other specifications on our website are the exclusive property or licensed use of Enfermera Clinical only. Any copying, transmission or re-transmission of the same requires our prior written approval, failing which the former is prohibited.

Privacy policy and data protection

Enfermera Clinical gathers and uses your information in accordance with the UK General Data Protection Regulation (“UK GDPR”) tailored by the Data Protection Act 2018 and any UK related implementing legislation (“applicable data protection legislation”). Enfermera Clinical will process your data securely and transparently.

Advertising and promotions

Enfermera Clinical reserves the right at all times to place advertisements and/or marketing promotions on the website. Advertisers and sponsors on our website, if any, must comply with all local, national, state and international laws (where relevant) and are solely liable for their actions.

Health and safety

All parties to this agreement agree to follow current UK Government guidelines concerning COVID-19. Enfermera Clinical agrees to provide up to date health and safety processes in writing to the Client prior to the booked training session.

These processes may be subject to change in order to ensure that we are all able to comply with up to date guidelines, legal requirements and/or good practice and notice of proposed changes will be provided to the parties prior to the event date, or as soon as reasonably practicable.

Disclaimer

All the information on Enfermera Clinical’s website is provided "as is". Enfermera Clinical makes no warranties, may it be expressed or implied, therefore negates all other warranties. The information on our website is for information purposes only and, although we have made every effort to ensure the correctness of the information, the said information is provided as stated/specified/displayed and without warranties or conditions of any kind whether express or implied. Furthermore, Enfermera Clinical does not make any representations concerning the accuracy or reliability of the use of the information on its website or otherwise or any sites linked to our website.

 

Limitation of liability

To the fullest extent allowed by the law, under no circumstances, including, but not limited to, negligence, are we liable to you or any recipient, for any direct, indirect, incidental, special or consequential damages that result from the use of and/or the inability to use the information on our website, any changes to the website, data sent or received or for any of the above-mentioned damages that result from the use or inability to use our website or services. This does not impact your legal right of recourse under the relevant data protection legislation within the UK.

Some jurisdictions do not allow limitations on implied warranties or limitations of liability for incidental damages and therefore these limitations may not apply to you depending on your jurisdiction.

Subject to the below clauses, the full liability of Enfermera Clinical, in connection with the contract whether for negligence, breach of contract, misrepresentation or otherwise, will be limited to an amount equal to the fee agreed for the service with the Client.

The liability of Enfermera Clinical in connection with the contract, whether for negligence, breach of contract, misrepresentation or otherwise, will not extend to special, indirect or consequential damages or losses, or any loss of profits, loss of revenue, loss of data, loss of contracts or opportunity, whether direct or indirect, even if the Client has advised us of the possibility, or if they were within our knowledge or understanding. 

Nothing in these conditions shall operate to exclude or restrict either party’s liability for:

  • death or personal injury resulting from negligence;
  • fraud or deceit.

Proprietary rights

All of the content which includes but is not limited to text, software, music, sound, photographs, video, graphics or other material on Enfermera Clinical's website, within our advertisements, commercial information from our website, by us, or our advertisers or any other content providers, is protected by trademarks, copyrights, patents/service marks and/or other proprietary rights and laws that are applicable.

Performance of our contractual obligations and legal jurisdiction

We shall not be liable for any failure to perform our obligations here at Enfermera Clinical under these terms and conditions as a result of circumstances that are beyond our reasonable control. This includes but is not limited to a 'force majeure' incident. Any such failure to exercise or enforce a right or provision of the terms of use will not constitute a waiver of such right or provision unless we have both acknowledged and agreed this in writing.

The terms of use are governed by and construed fully in accordance with the laws of the UK. We both agree to submit to the exclusive jurisdiction of the courts located in the UK. If any provision of the terms of use is held by a court of jurisdiction to be contrary to law, then such provision will be construed to reflect the intentions of the parties with the other provisions that are in full force and effect.

Amending the terms and conditions including our policies

Enfermera Clinical reserves the right to change the terms or any policies regarding the use of the website or our services and may notify you by the act itself of posting an updated version of our terms on our website. The materials on our website may include technical, typographical, or photographic errors and we cannot promise all the materials are completely accurate. Enfermera Clinical may need to change the materials, at any time, without giving prior notice.

Changing or terminating our website

We may amend or terminate our website with or without an explanation at any time and effective immediately. In addition, we reserve the right to terminate your ability to comment on our blogs/news on our website, in the event that there has been any violation of our terms and conditions or policies, regardless of the reason that has resulted in such violation. If you have made an accidental oversight during the use of our website, which may potentially, or, has violated these terms and conditions, please contact us immediately by email on enquiries@enfermeraclinical.com.
